. albert brown's attorneys filed the appeal after the u.s. district judge, jeremy fogle of san jose cleared the way for the execution. in 2006, the same judge ordered prison officials to stop the death penalty and overhaul the lethal injection cocktail after concerns it amounted to cruel and unusual punishment. since then, san quentin's death chamber has been rebuilt and the state adopted new regulation. the regulations have not been reviewed by a judge causing concern about legality. >> i think it's a great concern that a judge is that familiar with this issue is not willing to say let's just take a deep breath and take a look at it. this rush to execution makes no sense, considering the enormity and the irreversibility of what we do. >> brown is on death row for the 1980 rape and murder for a 15-year-old riverside girl. he is set to die on wednesday. >>> meg whitman and jerry brown will square off for the first time. no political commercials, just straight talk. we have a look from our sacramento station. >> a "los angeles times," usc poll shows jerry brown ahead by four percentage points

morning, everyone. thanks for joining us. i'm laura garcia-cannon. >> and i'm brent cannon. the time is 5:01. we want to check in with jennifer hill and take a look at still a pretty warm day but we're headed to the cooler section now. >> yes, finally we're sliding down and getting some cooler air coming into the region. also some reports of low clouds. yes, some clouds are back and high clouds down around santa cruz. 69 degrees the forecast temperature in oakland, 75 in santa rosa. 83 in fairfield. instead of the 90s happening at noon, they'll happen at 4:00. 94 in livermore, 80 in san rafael. san francisco getting the cooldown early with a 68-degree temperature and 75 in santa cruz. coming up we'll take a look at the weekend outlook. >> that's a pretty big change temperaturewise. we have a change on the roadway not quite so significant but a rolling traffic break starting around the coliseum heading up through downtown and ending by about 23rd, maybe up towards broadway because they're picking up cone zones on the northbound side. southbound side construction likely to pick up the next

have begun to put the brakes on this recession. the worst may be behind us. >> here is what the website from the white house tauted earlier in the summer. it was recovery summer as it was billed by the white house in campaign across the country as administration kicked off events across the country. here's the economic record which is still quite bleak. 9.6% unemployment. 16 months of straight 9% or higher unemployment. 54,000 jobs lost in august. 14.9 million unemployed. 6.2 million of which are long-term unemployed. and just today in "the new york times" a reminder of the real cost of this. a story that we see as the economy tumbles, numbers of families in shelters rise. you've had a rise in the number of families actually going into homeless shelters. it's a question of the president's rhetoric versus reality. are those things out of sync? >> no, they're not out of sync. obviously in april we were on a slightly greater scheme than we were over the summer because we had a fiscal crisis that took 15% off the stock market and caused businesses to retrench further but reality remains tha
